Please read these Terms and Conditions ("Terms", "Terms and Conditions") carefully before using the Storish mobile application operated by Ahmet Hakan Erşahin ("us", "we", or "our"). These Terms constitute a legally binding agreement between you and Storish App regarding your use of the website at https://storish.app (the "Website"), the Storish - Learn English mobile application ("Storish" or the "App"), and related services, including all information, text, graphics, software, and emails ("Content"). The Website, App, Content, and our services will collectively be referred to as the "Services".
 
This is an automatically renewing subscription service. We provide information about our Subscription Policy at or near the point of purchase. Please read these Terms carefully before starting a free trial or purchasing the App's auto-renewing subscription services. To avoid charges, you must cancel your subscription or trial at least 24 hours before the end of the free trial or the current subscription period. If you are unsure how to cancel, please visit the Apple Support or Google Play Help website, depending on where you purchased your subscription. Deleting the App does not cancel subscriptions or free trials. You may wish to take a screenshot of this information for reference.

IMPORTANT NOTICE REGARDING ARBITRATION FOR US CUSTOMERS: BY AGREEING TO THESE TERMS, YOU AGREE TO RESOLVE ANY DISPUTE BETWEEN YOU AND Storish APP THROUGH BINDING, INDIVIDUAL ARBITRATION RATHER THAN IN COURT (WITH LIMITED EXCEPTIONS). PLEASE REVIEW SECTION 13 "MANDATORY BINDING ARBITRATION AND CLASS ACTION WAIVER" BELOW FOR DETAILS.

1. General Conditions
These Terms create a legally binding agreement between you and Storish App. PLEASE READ THE TERMS CAREFULLY BEFORE USING THE SERVICES.

Please review our Privacy Policy. The terms of the Privacy Policy and other supplemental terms, policies, or documents that may be posted on the Services from time to time are expressly incorporated herein by reference.

We may modify these Terms on this page of the Website. We may notify you of critical changes via email or by posting notices on the Services, but we are not obliged to do so in every case. Any changes will be indicated by updating the "Last updated" date of these Terms, and you waive the right to receive specific notice of each change. If you do not agree to the changes, you must stop using the Services. Your continued use of the Services after changes are made to these Terms means you accept them.

IF YOU DO NOT AGREE TO ANY PART OF THESE TERMS OR IF YOU ARE NOT ELIGIBLE OR AUTHORIZED TO BE BOUND BY THESE TERMS, DO NOT DOWNLOAD THE APP OR USE THE SERVICES.

2. Important Disclaimers

The App contains summaries based on key insights derived from non-fiction books. The information in these summaries is for educational purposes only.

We do not provide medical advice or other health services, including testing, diagnosis, or assessment regarding mental health. If you have any health problems, consult your doctor or other healthcare professionals.

The ideas explained in the summaries are the personal thoughts of the authors and do not belong to us. We make no guarantees regarding the success you may achieve by following the advice and strategies in the book summaries, and you accept that results may vary.

None of the mentioned authors endorse or sponsor the App or our products, services, or activities. Mention of authors does not constitute an endorsement by us. Nothing in the App implies that the mentioned authors authorize, support, endorse, or sponsor any of our products or services.

3. Profile Registration
To use the Services, you may OPTIONALLY register a profile ("Profile") on the App and provide certain information.Alternatively, you can use the Services anonymously by selecting "Skip" during sign-up. Anonymous users are assigned a unique User ID and can access all features without providing personal information.

If you register a Profile, you represent and warrant that: (i) all registration information is true and accurate; (ii) you will maintain the accuracy of this information; and (iii) your use of the Services will not violate any applicable law, regulation, or these Terms. Otherwise, the Services may not function correctly, and we may not be able to contact you for important notices.

The Services are not designed for individuals under the age of 16. You represent and warrant that you meet this age requirement. Users who are minors in their jurisdiction (generally under 18) must have the permission and supervision of a parent or guardian to use the Services. If you are a minor, your parent or guardian must read and accept these Terms before you use the Services.

If you violate these Terms, we reserve the right to suspend or terminate your Profile or access to the Services, with or without notice.

You are responsible for maintaining the confidentiality of your Profile login information and are fully responsible for all activities that occur under your Profile. Immediately notify us of any unauthorized use or suspected unauthorized use of your Profile or any other breach of security. Storish App is not responsible for any loss or damage arising from your failure to comply with these requirements.

By using the Services, you agree to receive certain communications from Storish App regarding the Services, such as updates, a periodic email newsletter, or push notifications. You can opt out of non-mandatory communications by unsubscribing from the email newsletter or adjusting your device's notification preferences.

3.1. Anonymous Users

You may use Storish anonymously without registering a profile by selecting "Skip" during sign-up. Anonymous users are assigned a unique User ID, and their data (reading progress, saved words, quiz results, and subscription status) is stored securely on our servers.

Anonymous users can access all features of the Services, including premium subscriptions. However, without linking to an email address, anonymous users cannot recover their data if the app is deleted or if they switch devices.

Anonymous users may link their account to an email address at any time from the Account Settings. When linked, the User ID remains the same and all existing data is preserved.

4. Services

You agree that your use of the Services will be consistent with the license, covenants, and restrictions and will not infringe or violate the rights of any other party or breach any contract or legal duty. You will comply with all applicable laws, regulations, and ordinances regarding the Services and your use thereof.

You are solely responsible for providing the equipment and telecommunication services necessary to access the Services and all related fees (such as computing devices and Internet service provider fees).

We reserve the right to make changes to the Services (free or paid features) at any time without notice or liability. Your access to the Services may be impaired or prevented due to various actions, and Storish App bears no responsibility or liability for such actions, including the deletion of any content or service.

Your access to and use of the Services is entirely at your own risk. We are not responsible for any damage to your computing system, loss of data, or other damages resulting from your access to, use of, or reliance on any information or advice in the Services.

We have no obligation to provide customer support. However, Storish App may provide support at its sole discretion.

5. Third Party Additional Packages

Users may be offered additional packages, products, or modules in addition to main packages. These additional packages are added to and linked to the user's main subscription package. Therefore, if the main package subscription expires, the additional packages also expire. The content of additional packages may be changed or updated over time. The purchased package is valid with its scope at the date of purchase. There is no guarantee for subsequent features or updates.

6. Intellectual Property and User Content

All text, images, marks, logos, compilations, data, other content, software, and materials displayed on the Services or used by Storish App, excluding User Content, are owned by Storish App or third parties.

Storish App reserves all rights, including intellectual property rights in all of the foregoing. Except as explicitly permitted in these Terms, any use, redistribution, sale, decompilation, reverse engineering, disassembly, translation, or other exploitation is strictly prohibited. The provision of the Services does not transfer to you or any third party any right, title, or interest in such intellectual property rights.

The information you submit as part of your registration process and any data, text, and other material you submit or post ("User Content") remain your intellectual property, and we do not claim ownership over such User Content. You agree that Storish App may retain copies of all registration information and User Content and use them as reasonably necessary for the operation of the Services and as described in these Terms and the Privacy Policy.

You grant Storish App a non-exclusive, worldwide, transferable, perpetual, irrevocable right to publish, distribute, publicly display, and perform User Content in connection with the Services.

Subject to these Terms, Storish App grants you a non-transferable, non-exclusive license (without the right to sublicense) to use the Services for your personal, non-commercial purposes and to install and use the App on your handheld mobile device for your personal, non-commercial purposes.

7. App Stores, Third Party Ads, Other Users

The availability of the App depends on the third party from whom you received the App, such as the Apple App Store or Google Play Market (collectively "App Stores").

You agree to pay all fees charged by the App Stores in connection with the App. Your license to use the App is conditioned upon your compliance with all applicable agreements, terms of use, and policies of the App Stores. The App Stores are third-party beneficiaries of these Terms and have the right to enforce these Terms.

The Services may contain links to third-party websites or resources and advertisements owned by third parties ("Third Party Ads"). Storish App is not responsible for any Third Party Ads. We provide these Third Party Ads as a convenience and do not review, approve, monitor, endorse, warrant, or make any representations with respect to them. You assume all risks arising from your use of such websites or resources. Your dealings with Third Party Ads, including payment and delivery of goods or services, are solely between you and the merchant or advertiser.

Each user of the Services is responsible for their own User Content. Storish App is not responsible for any User Content and does not guarantee its accuracy, currency, suitability, or quality. Your interactions with other Services users are solely between you and the user. Storish App is not responsible for any loss or damage arising from such interactions. If there is a dispute between you and any Services user, Storish App is under no obligation to become involved.

You release us, our officers, employees, agents, and successors from claims, disputes, costs, losses, liabilities, damages, expenses, and judgments of every kind arising out of interactions with or the conduct of any App Store, other Services users, or Third Party Ads.

8. User Representations and Restrictions

By using the Services, you represent and warrant that:

• You have the legal capacity and you agree to comply with these Terms;

• You are not under 16 years of age;

• You will not access the Services through automated or non-human means, such as bots or scripts;

• You will not use the Services for any illegal or unauthorized purpose;

• You are not located in a country that is subject to a U.S. government embargo, or that has been designated by the U.S. government as a "terrorist supporting" country;

• You are not listed on any U.S. government list of prohibited or restricted parties;

• Your use of the Services will not violate any applicable law or regulation.

If you provide any information that is untrue, inaccurate, not current, or incomplete, we have the right to refuse any current or future use of the Services.

You may not use the Services for any purpose other than that for which we make the Services available. The Service may not be used in connection with any commercial endeavors unless specifically authorized.

As a user of the Services, you agree not to:

• Systematically retrieve data or other content from the Services to create or compile a collection or database without written permission;

• Make any unauthorized use of the Services;

• Modify, adapt, improve, translate, or create derivative works from the Services;

• Use the Services for any revenue-generating endeavor or commercial enterprise;

• Make the Services available over a network where they could be used by multiple devices or users at the same time;

• Use the Services to create a product, service, or software that competes with or substitutes the Services;

• Use proprietary information or any of our interfaces in the design or development of applications for use with the Services;

• Circumvent, disable, or otherwise interfere with security-related features of the Services;

• Engage in unauthorized framing of or linking to the Services;

• Interfere with, disrupt, or create an undue burden on the Service or the networks connected to the Services;

• Decipher, decompile, disassemble, or reverse engineer any of the software comprising the Services;

• Bypass any measures designed to prevent or restrict access to the Services;

• Upload or distribute files that contain viruses, worms, Trojan horses, or other harmful software;

• Use automated systems to access the Services or send unsolicited commercial emails;

• Disparage, tarnish, or otherwise harm Storish App and/or the Services;

• Use the Services in a manner inconsistent with applicable laws or regulations;

• Violate these Terms.

9. Indemnification

You agree to indemnify and hold harmless Storish App and its affiliates from any claim, dispute, cost, loss, liability, damage, expense, and judgment arising out of your use of the Services, User Content, or your violation of these Terms.

10. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. WE DISCLAIM ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, QUIET ENJOYMENT, AND NON-INFRINGEMENT. We do not warrant that the Services will meet your requirements or be uninterrupted, secure, or error-free. Your use of the Services is at your own risk.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, Storish App AND ITS SERVICE PROVIDERS SHALL NOT BE LIABLE FOR ANY INCIDENTAL, SPECIAL, EXEMPLARY, OR CONSEQUENTIAL DAMAGES, INCLUDING LOSS OF PROFITS, REVENUE, SAVINGS, BUSINESS OPPORTUNITY, DATA, OR GOODWILL, SERVICE INTERRUPTION, COMPUTER DAMAGE, OR SYSTEM FAILURE ARISING OUT OF THESE TERMS OR THE USE OF THE SERVICES. Storish App'S AGGREGATE LIABILITY SHALL NOT EXCEED THE AMOUNTS YOU HAVE PAID TO Storish App FOR THE SERVICES OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.
LIMITATIONS OF DAMAGES ARE FUNDAMENTAL ELEMENTS OF THE BASIS OF THE BARGAIN BETWEEN Storish App AND YOU.

12. International Use

Storish App makes no representation that the Services are legally available for use in your jurisdiction. Accessing and using the Services from territories where it is illegal is prohibited. You are responsible for compliance with local laws.

13. Dispute Resolution and Governing Law

Dispute Resolution This section applies to any dispute, action, or controversy between you and Storish arising out of or relating to the Services or this agreement, whether based in contract, warranty, tort, statute, regulation, or any other legal or equitable basis.

Dispute Notice In the event of a dispute, you or Storish must provide the other party with a written notice of dispute that includes the name and contact information of the party giving notice, the facts giving rise to the dispute, and the relief requested. You must send any Dispute Notice via email to: support@storish.app. We will send any Dispute Notice to you by mail if we have it, or otherwise to your email address. The parties will attempt to resolve the dispute through informal negotiation within fifty (50) days from the date the notice is sent.

Governing Law and Jurisdiction If the dispute is not resolved through informal negotiation within fifty (50) days, either party may commence an action in court. This agreement shall be governed by and construed in accordance with the laws of the Republic of Türkiye, without regard to conflict of law principles. Any legal action or proceeding arising out of or related to this agreement shall be brought exclusively in the authorized courts and execution offices of Istanbul, Türkiye, and the Parties hereby consent to the personal jurisdiction and venue of such courts.

14. Miscellaneous Provisions

Storish App's failure or delay in exercising any right under these Terms shall not weaken such rights or constitute a waiver. A waiver by Storish App of any breach does not constitute a waiver of any subsequent breach.

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in effect and be reformed to reflect the intent of the parties.

These Terms set forth the entire agreement between you and Storish App and supersede all prior agreements regarding the subject matter hereof.

We may assign our rights and obligations under these Terms. By accepting these Terms, you consent to such assignment. Notice of assignment will be provided by updating these Terms.

All communications on the Services are considered electronic. You agree that electronic communications, including notices, disclosures, agreements, and records, are equivalent to written communications and are legally binding. By clicking on buttons such as "SUBMIT", "CONTINUE", "REGISTER", "I AGREE" or similar, you are submitting a legally binding electronic signature.
Storish App is not responsible for any failure to comply with these Terms due to factors beyond its control.

15. Refunds and Cancellation

I. Subscription When you start using the Storish mobile application, you will have access to the basic features of the Storish mobile application. Access to Storish's unlimited features requires a paid subscription. Some parts of the Service are billed on a subscription basis ("Subscription(s)"). Your payment will be billed in advance on a recurring and periodic basis ("Billing Cycle"). A full list of Storish's features and pricing is provided within the app. Billing cycles are determined on a weekly, monthly, or annual basis depending on the type of subscription plan you select when purchasing a Subscription. At the end of each Billing Cycle, your Subscription will automatically renew under the exact same conditions unless you cancel it. You may cancel your Subscription renewal and management through the Apple App Store or Google Play Store account settings of the platform where you purchased the subscription. To prevent automatic renewal of your Subscriptions, you must cancel at least 24 hours before the current Billing Cycle ends. Please review the terms and conditions of the relevant app store (Apple App Store or Google Play Store) for cancellation steps and policies.

II. Free Tier During your daily book or story reading or vocabulary quiz session, you may have the opportunity to explore free tier options with specific (ad-supported) conditions and in a limited manner. After that, you will need to choose one of the available paid subscription plans to continue using the app.

III. FREE TRIAL STORISH may, at its sole discretion, offer a Subscription with a free trial for a limited time ("Free Trial"). If you enter your billing information when signing up for the Free Trial, you will not be charged by STORISH until the Free Trial has expired. On the last day of the Free Trial period, unless you cancel your Subscription, you will be automatically charged the applicable Subscription fees for the type of Subscription you have selected.

IV. FEE CHANGES STORISH, in its sole discretion and at any time, may modify the Subscription fees for the Subscriptions. Any Subscription fee change will become effective at the end of the then-current Billing Cycle. STORISH will provide you with reasonable prior notice of any change in Subscription fees to give you an opportunity to terminate your Subscription before such change becomes effective. Your continued use of the Service after the Subscription fee change comes into effect constitutes your agreement to pay the modified Subscription fee amount.

V. Refunds All purchases made through our Application are within the scope of digital content and are considered non-refundable and non-exchangeable unless otherwise required by law or specifically stated in this policy. You acknowledge that when you complete a purchase, the digital service is immediately made available and the service is deemed fully performed upon delivery.

16. Records and Integrity

In disputes that may arise from the use of Storish, all electronic and commercial records, user information, logs of Ahmet Hakan Erşahin, and email notifications made by Ahmet Hakan Erşahin to Users, including but not limited to these, constitute definitive and exclusive evidence.

If any court or administrative authority decides that various provisions of these Terms of Use are unlawful, the other articles shall remain valid and in force.
